Terms of Service
1. Who we are
WhichMix is operated by Pristine3D Limited (“Pristine3D”, “we”, “us”), a company registered in Nigeria. These Terms are the agreement between you and Pristine3D about whichmix.com and the WhichMix service. By creating an account, accepting an invitation, or using the service, you agree to these Terms and to our Privacy Policy. Support and legal notices: [email protected]. If you use WhichMix for a band, studio, or company, you confirm you are allowed to bind it to these Terms.
2. What WhichMix is
WhichMix keeps the work around a song in one place: mix versions in order with their full history, notes pinned to the moment in the audio they refer to, approvals recorded against the exact version approved, files (sessions, stems, artwork, lyrics), song metadata and credits, the people involved and their roles, share links for listening, and an activity log. A storage plan sets how many bytes a workspace can hold.
WhichMix is not a DAW, an audio editor, a distributor, a chat app, or a backup service. We do not sell, license, distribute, or promote your music — we store it and serve it back to the people you allow.
3. Accounts
- You must be at least 16 years old to use WhichMix.
- Give us accurate information and keep your password and devices secure. You are responsible for what happens through your account, including invitations you send and share links you create.
- One account per person. Tell us promptly about unauthorised use or a suspected compromise.
- If you agree to these Terms on behalf of an organisation, you confirm you can bind that organisation.
4. Workspaces, roles and collaborators
The workspace host pays for the plan, controls it, and decides who joins and with which role (host, editor, or reviewer). Members see what their role allows. Invitations are sent by email to the address you provide — if you invite someone, you confirm you may share that work with them. Removing a member or revoking a link cuts off future access; it does not delete the work that person contributed. Access is practical, not certified identity — invite only people you trust with unreleased music.
5. Plans, billing and taxes
- The Free plan (5 GB) costs nothing and needs no card. Paid plans — Creator, Studio, and Label — are billed in US dollars, monthly or yearly, with the storage limits shown on our pricing. Only the host pays; collaborators are free.
- Paid plans are subscriptions: they renew automatically at the end of each period until cancelled. You can cancel at any time from the billing portal; access continues to the end of the period you paid for, then the workspace moves to the Free plan.
- Payments are made through Creem, our merchant of record. Creem is the seller of record for each transaction: it processes the payment, calculates, collects and remits applicable taxes (VAT, GST, sales tax), issues the invoice, and processes refunds. Your card details never reach us. Creem’s own terms also apply to the payment.
- If a plan ends or a payment fails and the workspace is over the Free limit, we pause new uploads until you are back within it or reactivate a plan. We do not delete your work to reclaim space.
- We may change prices. Changes are announced in advance and apply to new subscriptions and to renewals after the notice period; a period you have already paid for is never repriced.
6. Refunds
If a paid plan is not for you, ask us within 14 days of your first payment and we will refund it. After that window, fees already paid are not refundable — but you can still cancel at any time to stop the next renewal. Nothing in these Terms removes a stronger right you have under mandatory consumer law where you live.
7. Your content — you keep it all
- Your music, recordings, sessions, artwork, lyrics, notes, credits, and metadata remain yours (or your licensors’). We claim no ownership of your content.
- To run WhichMix we need one limited licence: to store and copy your content, transmit it, transcode it where we must (for playback, waveforms, and voice notes), back it up, and display it to the people and links you have authorised. That licence exists only to operate the service, and it ends when the content is deleted — except in backups, which rotate out on their own schedule (see the Privacy Policy).
- We do not use your content to train AI models. We never sell your content, and we never publish or promote it publicly without your written permission.
- You confirm you own, or have the rights to, everything you upload, and that you may invite the people you invite. As between us and you, the host is responsible for the workspace’s content and for who was given access to it.
8. Confidentiality and access
Work on WhichMix is private unless someone with access shares it. Access follows roles and links you control. Our support tools show metadata, roles, and history — not your audio — and we do not listen to your files, except where you ask us to in a support conversation, or where the law compels us (see the Privacy Policy). Anyone who holds a working share link (and its PIN, if you set one) can play what it exposes, so treat a link as you would treat the file.
9. Share links
For each link you choose what it allows (listen only, or listen and leave notes), whether it needs a PIN or an expiry date, and whether it follows the latest version or stays stamped to the exact versions it was made for. Revoking a link ends access through it; it cannot take back copies someone already downloaded or recorded. Do not create links for people you do not want to have the work.
10. Acceptable use
Do not use WhichMix to:
- store or share content you have no right to, or anything unlawful;
- reach workspaces, files, or accounts you were not granted;
- probe or breach the service’s security, or get around its limits (including the storage limit);
- resell or rebrand the service, scrape it, or use it to send spam;
- upload malware or use the service to harm anyone.
We may suspend accounts that put the service, our providers, or other people at risk.
11. Copyright complaints
If you believe content on WhichMix infringes your rights, write to [email protected] with enough information for us to find the content and understand the claim. We will look into it, may disable or remove the content, and will terminate repeat infringers.
12. Our rights
WhichMix — the service, the software, the wordmark, and the design — belongs to us and our licensors. These Terms give you the right to use the service, nothing more. If you send us feedback or ideas, we may use them without obligation to you.
13. Availability and support
We work to keep WhichMix running and your bytes intact, but we promise no uptime level and the service is provided without an SLA. We may do maintenance, and may add, change, or remove features. If we discontinue the service, we will give you at least 90 days’ notice and a reasonable way to download your content. Support: [email protected] — we aim to reply within three business days.
14. Suspension and termination
- You can stop using WhichMix at any time. To delete your account, email us; we will confirm and delete your personal data as the Privacy Policy describes.
- We may suspend or terminate an account that breaks these Terms, puts the service or others at risk, or where the law requires it. Except where notice would defeat the purpose (fraud, security, legal compulsion), we will say why and give you a reasonable window to retrieve your files.
- When an account ends, your right to use the service ends with it.
15. Disclaimers
WhichMix is provided “as is” and “as available”. To the maximum extent the law allows, we disclaim implied warranties, including merchantability, fitness for a particular purpose, and non-infringement. We do not promise the service will be uninterrupted or error-free, and no system is immune to loss. Keep your own copies of masters, sessions, and anything irreplaceable — WhichMix is a working surface, not your archive of record.
16. Limitation of liability
To the maximum extent the law allows: we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, goodwill, or data. Our total liability for everything connected to the service is limited to the greater of (a) what you paid us in the twelve months before the event, or (b) US$100. Nothing here limits liability that cannot be limited by law — including for fraud, or for death or personal injury caused by negligence. If you are a consumer, this section does not override rights you have under mandatory law.
17. Indemnity
You will indemnify Pristine3D Limited against third-party claims, losses, and reasonable costs that arise from your content, your use of the service, your breach of these Terms, or your infringement of anyone else’s rights — including claims by artists, labels, or collaborators about music you stored or shared.
18. Governing law and disputes
These Terms are governed by the laws of the Federal Republic of Nigeria, and you and we submit to the exclusive jurisdiction of the Nigerian courts. If consumer law where you live gives you the right to bring a claim locally, that right is unaffected. Before filing anything, please write to [email protected] — most things are solved there.
19. Changes to these Terms
We may update these Terms as the product and the law change. For material changes we will give notice (by email or in the app) before they take effect. Continuing to use WhichMix after that means you accept the new Terms; if you do not, stop using the service and cancel.
20. General
If a provision of these Terms is unenforceable, the rest remains in force. You may not assign these Terms; we may assign them as part of a merger, acquisition, or sale of assets. These Terms and the Privacy Policy are the entire agreement between us. Our failure to enforce a provision is not a waiver of it.
